How PIPA and SOPA Violate White House Principles Supporting Free Speech and Innovation

Help fight the blacklist bills! Please take action by contacting Congress through our action center. It only takes a moment and it can make a big difference.

Over the weekend, the Obama administration issued a potentially game-changing statement on the blacklist bills, saying it would oppose PIPA and SOPA as written, and drew an important line in the sand by emphasizing that it “will not support” any bill “that reduces freedom of expression, increases cybersecurity risk, or undermines the dynamic, innovative global Internet."

Yet, the fight is still far from over. Even though the New York Times reported that the White House statement "all but kill[s] current versions of the legislation," the Senate is still poised to bring PIPA to the floor next week, and we can expect SOPA proponents in the House to try to revive the legislation—unless they get the message that these initiatives must stop, now. So let’s take a look at the dangerous provisions in the blacklist bills that would violate the White House’s own principles by damaging free speech, Internet security, and online innovation:

The Anti-Circumvention Provision

In addition to going after websites allegedly directly involved in copyright infringement, a proposal in SOPA will allow the government to target sites that simply provide information that could help users get around the bills’ censorship mechanisms. Such a provision would not only amount to an unconstitutional prior restraint against protected speech, but would severely damage online innovation. And contrary to claims by SOPA’s supporters, this provision—at least what’s been proposed so far—applies to all websites, even those in the U.S.

As First Amendment expert Marvin Ammori points out, “The language is pretty vague, but it appears all these companies must monitor their sites for anti-circumvention so they are not subject to court actions ‘enjoining’ them from continuing to provide ‘such product or service.’” That means social media sites like Facebook or YouTube—basically any site with user generated content—would have to police their own sites, forcing huge liability costs onto countless Internet companies. This is exactly why venture capitalists have said en masse they won’t invest in online startups if PIPA and SOPA pass. Websites would be forced to block anything from a user post about browser add-ons like DeSopa, to a simple list of IP addresses of already-blocked sites.

Perhaps worse, EFF has detailed how this provision would also decimate the open source software community. Anyone who writes or distributes Virtual Private Network, proxy, privacy or anonymization software would be negatively affected. This includes organizations that are funded by the State Department to create circumvention software to help democratic activists get around authoritarian regimes’ online censorship mechanisms. Ironically, SOPA would not only institute the same practices as these regimes, but would essentially outlaw the tools used by activists to circumvent censorship in countries like Iran and China as well.

The “Vigilante” Provision

Another dangerous provision in PIPA and SOPA that hasn’t received a lot of attention is the “vigilante” provision, which would grant broad immunity to all service providers if they overblock innocent users or block sites voluntarily with no judicial oversight at all. The standard for immunity is incredibly low and the potential for abuse is off the charts. Intermediaries only need to act “in good faith” and base their decision “on credible evidence” to receive immunity.

As we noted months ago, this provision would allow the MPAA and RIAA to create literal blacklists of sites they want censored. Intermediaries will find themselves under pressure to act to avoid court orders, creating a vehicle for corporations to censor sites—even those in the U.S.—without any legal oversight. And as Public Knowledge has pointed out, not only can this provision be used for bogus copyright claims that are protected by fair use, but large corporations can take advantage of it to stamp out emerging competitors and skirt anti-trust laws:

For instance, an Internet service provider could block DNS requests for a website offering online video that competed with its cable television offerings, based upon “credible evidence” that the site was, in its own estimation, promoting its use for infringement....While the amendment requires that the action be taken in good faith, the blocked site now bears the burden of proving either its innocence or the bad faith of its accuser in order to be unblocked.

Corporate Right of Action

PIPA and SOPA also still allow copyright holders to get an unopposed court order to cut off foreign websites from payment processors and advertisers. As we have continually highlighted, copyright holders already can remove infringing material from the web under the DMCA notice-and-takedown procedure. Unfortunately, we’ve seen that power abused time and again. Yet the proponents of PIPA and SOPA want to give rightsholders even morepower, allowing them to essentially shut down full sites instead of removing the specific infringing content.

While this provision only affects foreign sites, it still affects Americans' free speech rights. As Marvin Ammori explained, "The seminal case of Lamont v. Postmaster makes it clear that Americans have the First Amendment right to read and listen to foreign speech, even if the foreigners lack a First Amendment speech right." If history is any guide—and we’re afraid it is—we will see specious claims to wholesale take downs of legitimate and protected speech.

Expanded Attorney General Powers

PIPA and SOPA would also give the Attorney General new authority to block domain name services, a provision that has been universally criticized by both Internet security experts and First Amendment scholars. Even the blacklist bills’ authors are now publicly second-guessing that scary provision. But even without it, this section would still force many intermediaries to become the Internet police by putting the responsibility of censorship enforcement on those intermediaries, who are usually innocent third parties.

The Attorney General would also be empowered to de-list websites from search engines, which, as Google Chairman Eric Schmidt noted, would still "criminalize linking and the fundamental structure of the Internet itself." The same applies to payment processors and advertisers.

These are just some of the egregious provisions in PIPA and SOPA that would drastically change the way we use the Internet (for the worse), and punish millions of innocent users who have never even thought about copyright infringement. As Reddit co-founder Alexis Ohanian explained, PIPA and SOPA are “the equivalent of being angry and trying to take action against Ford just because a Mustang was used in a bank robbery.” These bills must be stopped if we want to protect free speech and innovation on the web.

Well folks it's been a while since we have posted anything. Basically we've all been too busy or lazy to update, not like the same old same old has changed much. Let's hope we get a decent choice for President because the one in charge now is still pushing us over a cliff. Maybe we've just decided to give up and watch the carnage. 1. Obama's Internet Takeover to Begin Nov. 20th

Late last week, the Federal Communications Commission (FCC) took what is being called “the final step” towards implementing their illegal Net Neutrality regulations. The FCC’s Net Neutrality regulations would be job-killers -- likely stifling the $30 billion annually that investors pour into the Internet -- and will lead to the FCC’s control of Web content.

According to Less Government, despite multiple law suits, a move by the House of Representatives and a D.C. Circuit Court unanimously ruling that the FCC had no authority to take control, the FCC will finalize full implementation of the regulations on November 20.

This is the latest example of the surging statist expansion while private sector job opportunities continue to shrink. Now Americans are in danger of suffering a free speech “knockout blow” to one of the last, great free-market frontiers our nation and the world has ever seen -- the Internet.

2. Feds String Up Gibson Guitars

While the President tours the country, gleefully touting his “jobs creation bill,” his administration is aggressively assaulting private businesses who are actually in the business of creating real jobs!

Gibson Guitars, a Nashville, TN based company, has been raided twice by federal marshals and essentially shutdown over the wood used in their guitars. Despite the fact that no charges have been filed, the government did confiscate product and shutdown Gibson production, putting hundreds of real jobs in jeopardy.

Henry Juszkiewicz, Chairman and CEO of the company, insists Gibson has done nothing wrong and that the wood that was seized was legal, was approved by Indian authorities and even passed through U.S. customs.

Gibson, according to Juszkiewicz, has hired 580 workers over the last year. But now because of what he calls an “unjust, unfair and potentially illegal” action by the Department of Justice, Gibson has had to shut down production, no doubt jeopardizing hundreds of real jobs.

ACTION: This gross abuse of power is already being confronted as a number of Tea Party organizations are planning a rally for Gibson on October 8, in Nashville, TN.

3. School double standards are intolerable!

"I'm not saying he's looking forward to any of this, if he's charged. But at least there would be a sense of relief." While the Feds appear to be ready to call Team Kilpatrick an organized crime family, Kwame Kilpatrick is still trying to appeal his jail sentence for probation violations. In a motion filed with the state Supreme Court, Kilpatrick attorney Daniel Hajji argued that Kilpatrick's one-time lawyer Arnold Reed did not adequately represent his client. Reed fired back on Fox 2, questioning both Hajji's strategy with the appeal and his legal acumen. Dec. 15, Arnold Reed on Fox 2: "The kid has a lot of gumption. He's got a lot of wherewithal. Unfortunately, the knowledge does not comport with his gumption and legal prowess." Kilpatrick already faces 19 federal counts of mail fraud and tax evasion. He is currently serving a 14-60 month prison sentence for violating probation terms of his obstruction of justice and perjury guilty pleas.

Fed unveils $600 billion plan to boost economy

WASHINGTON -- The Federal Reserve announced a bold plan today to try to invigorate the economy by buying $600 billion more in Treasury bonds.

The Fed said it would buy about $75 billion a month in long-term government bonds through the middle of 2011 to further drive down interest rates on mortgages and other debt. This is in addition to an expected $250 billion to $300 billion in Fed purchases over the same period from reinvesting proceeds from its mortgage portfolio.

The idea is for cheaper loans to get people to spend more and stimulate hiring. The Fed said it will monitor whether adjustments are needed depending on how the economy is performing.

Some worry the Fed action will do little to boost the economy because interest rates are already historically low. Others fear the bond purchases could drive inflation too high over the long term and unleash speculative buying in assets like stocks.

The financial markets, which had priced in the Fed's move for weeks, didn't move much after the announcement. The Dow Jones industrial average fell 26 points soon afterward.

In announcing the action, the Fed said the pace of the economy continues to be slow. Companies remain reluctant to hire, housing activity is depressed and consumers are increasing their spending only gradually.

Thomas Hoenig, president of the Federal Reserve Bank of Kansas City, dissented for the sixth straight meeting. He says the risks of the Fed's extra stimulus outweigh the potential benefits.

With the economy weak, the Fed doesn't want to take chances that it could get stuck in the kind of economic stagnation and deflation problems that gripped Japan and led to a "lost decade" during the 1990s.

Deflation is a widespread and prolonged drop in prices of goods and services, in wages and in the values of homes and stocks. Deflation makes it harder for people and companies to pay their debts, pushing up home evictions and bankruptcies.

Fed policymakers expressed disappointment that they haven't been able to reduce unemployment -- now at 9.6 -- and raise inflation to levels more in line with a healthy economy. Progress toward those goals has been disappointingly slow, the Fed acknowledged in its post-meeting statement.

The Fed has tried since the 2008 financial crisis to keep credit available to individuals and businesses. It's done so, in part, by keeping the target range for its bank lending rate near zero.

It also pursued the unorthodox strategy of buying long-term bonds. The Fed's purchases are so vast that they push down the rates on those bonds.

In 2009, the Fed bought $1.7 trillion in mortgage and Treasury bonds. Those purchases helped lower long-term rates on home and corporate loans. The program was credited with helping to lift the country out of recession.

The action comes one day after voters frustrated by unemployment, scant pay gains and soaring home foreclosures punished Democrats and handed control of the House to Republicans. Democrats kept control of the Senate.

The split will make it harder for President Barack Obama to enact any major economic initiatives. That could put more pressure on the Fed to get the economy back on firmer footing.

Once again, the Fed pledged to hold its key interest rate at a record low near zero for "an extended period."

Employers remain reluctant to add to payrolls. Housing starts continue to be depressed. Longer-term inflation expectations have remained stable, but measures of underlying inflation have trended lower in recent quarters.
Consistent with its statutory mandate, the Committee seeks to foster maximum employment and price stability. Currently, the unemployment rate is elevated, and measures of underlying inflation are somewhat low, relative to levels that the Committee judges to be consistent, over the longer run, with its dual mandate. Although the Committee anticipates a gradual return to higher levels of resource utilization in a context of price stability, progress toward its objectives has been disappointingly slow.
To promote a stronger pace of economic recovery and to help ensure that inflation, over time, is at levels consistent with its mandate, the Committee decided today to expand its holdings of securities. The Committee will maintain its existing policy of reinvesting principal payments from its securities holdings. In addition, the Committee intends to purchase a further $600 billion of longer-term Treasury securities by the end of the second quarter of 2011, a pace of about $75 billion per month. The Committee will regularly review the pace of its securities purchases and the overall size of the asset-purchase program in light of incoming information and will adjust the program as needed to best foster maximum employment and price stability.
The Committee will maintain the target range for the federal funds rate at 0 to 1/4 percent and continues to anticipate that economic conditions, including low rates of resource utilization, subdued inflation trends, and stable inflation expectations, are likely to warrant exceptionally low levels for the federal funds rate for an extended period.
The Committee will continue to monitor the economic outlook and financial developments and will employ its policy tools as necessary to support the economic recovery and to help ensure that inflation, over time, is at levels consistent with its mandate.

Earlier last week, supporters of the DREAM Act failed to get enough votes to prevail. The Senate voted 56-43 to stop debate on the Defense Authorization Bill that included the DREAM Act. If this had passed, illegal aliens under age 36 would have been granted "a path to citizenship" (AMNESTY) if they served in the military or attended college. Fortunately, common sense and the desire to be reelected in 6 weeks allowed fewer than the required 60 senators to vote for this. (Under Senate rules, 60 votes is required to enact cloture and advance the bill.) However, it should be noted that 56 senators DID vote in favor of amnesty for illegals.

BREAKING NEWS - SENATE AMNESTY VOTE FAILS 56-43

Senate Leader Harry Reid's attempt to attach "the Dream Act" (amnesty) to the 2011 Defense Authorization Bill has FAILED by a vote of 56-43. Under the Senate rules, 60 votes are required to proceed.

WE WON TODAY!!! But this is not over. This bill will return to see another day. The proof of this is that Harry Reid was the final vote and he voted 'no.' In other words, he voted against the bill. The reason he did this was so he could bring up the bill at a later time. Before November if he has the necessary 60 votes (unlikely), or during the lame duck session of Congress which will take place after the elections. This stands a good chance of passing during the lame duck session since those senators who have been defeated by the voters will feel they have "nothing to lose" by voting amnesty for illegal aliens.

ROCHESTER, New York (AP) -- A federal judge on Friday approved Eastman Kodak Co.'s $21.4 million offer to settle class-action lawsuits by black employees who maintained white counterparts were favored over them for pay and promotion.

In an almost seven-year legal tussle, U.S. Magistrate Jonathan Feldman signed off on a deal that pays about 3,000 current and past Kodak workers amounts ranging from $1,000 to $50,000. The decision ends a 2004 class-action lawsuit and a similar suit filed by other black workers in 2007.

The Rochester, New York-based photography products maker was accused of paying black employees less than white co-workers, passing them over for promotions and maintaining a racially hostile work environment.

Last October, Feldman heard arguments in favor of the deal from Kodak and lawyers for the plaintiffs. He then fielded complaints from more than a dozen former employees who said proposed payouts were inadequate, lawyer fees too high and the offer unfairly excluded workers who left Kodak before 1999.

Under the settlement, 3,008 workers get $9.65 million and their lawyers $9.7 million in fees and expenses. Adjustments to individual awards were negotiated, with a dozen workers having $75,000 awards reduced by one-third.

The balance of the settlement will go to administering the claims and supporting enhanced diversity training for supervisors that Kodak promised as part of the deal. The company will also hire an industrial psychologist and two labor statisticians to review pay and promotion policies and recommend improvements.

In a statement, Kodak said the settlement "represents a resolution of mutual interest and it absolutely does not suggest any wrongdoing" on the company's part.

"Kodak is widely recognized as a company committed to creating and maintaining an inclusive workplace in which all employees are valued, treated fairly and can contribute to their full potential," it added.

The judge noted that a Kodak damage expert, Harvard University Professor David Bloom, analyzed historical payroll data and concluded "there were no race-based disparities in promotion and compensation at Kodak between 1999 and 2005 and African-Americans were, in fact, statistically favored in promotion and base salary increases during the 1999-2005 time period."

"These risks and others make the fairness of the settlement all the more evident and weigh in favor of approving the settlement agreement," the judge said in a 59-page decision.

MILWAUKEE — A combative President Barack Obama rolled out a long-term jobs program on Monday, September 6, that would exceed $50 billion to rebuild roads, railways and runways, and coupled it with a blunt campaign-season assault on Republicans for causing Americans' hard economic times.
GOP leaders instantly assailed Obama's proposal as an ineffective one that would simply raise already excessive federal spending. Many congressional Democrats are also likely to be reluctant to boost expenditures and increase federal deficits just weeks before elections that will determine control of Congress.

Jim Manley, spokesman for Senate Majority Leader Harry Reid of Nevada, cautioned, "If we are going to get anything done, Republican cooperation, which has been all but non-existent recently, will be necessary."

That left the plan with low, if not impossible, odds of becoming law this year. When Congress returns from summer recess in mid-September, it is likely to remain in session for only a few weeks before lawmakers return home to campaign for re-election.

Administration officials said that even if Congress quickly approved the program, it would not produce jobs until sometime next year. That means the proposal's only pre-election impact may be a political one as the White House tries to demonstrate to voters that it is working to boost the economy and create jobs.

At a Labor Day speech in Milwaukee, Obama said Republicans are betting that between now and the Nov. 2 elections, Americans will forget the Republican economic policies that led to the recession. He said Republicans have opposed virtually everything he has done to help the economy, and have proposed solutions that have only made the problem worse.

"That philosophy didn't work out so well for middle-class families all across America," Obama told a cheering crowd at a labor gathering. "It didn't work out so well for our country. All it did was rack up record deficits and result in the worst economic crisis since the Great Depression."

He said Republicans have consistently opposed his economic proposals and seem to be running on a slogan of "No, we can't," playing off his 2008 presidential campaign mantra of "Yes we can."

"If I said fish live in the sea, they'd say no," Obama said.

Republicans made clear that Obama should not expect any help from them.

Senate Republican Leader Mitch McConnell of Kentucky said the plan "should be met with justifiable skepticism." He said it would raise taxes while Americans are "still looking for the 'shovel-ready' jobs they were promised more than a year ago" in the $814 billion economic stimulus measure.

The House Republican leader, John Boehner of Ohio, added, "We don't need more government 'stimulus' spending. We need to end Washington Democrats' out-of-control spending spree, stop their tax hikes, and create jobs by eliminating the job-killing uncertainty that is hampering our small businesses."

Administration officials are hunting broadly for ways to revive the economy. But they are likely to drop a separate proposal to renew a law exempting companies from paying Social Security taxes on any unemployed workers they hire, according to a White House official who spoke on condition of anonymity because the decision was not final.

Casual in brown slacks and open-collar white shirt with rolled-up sleeves, Obama took a populist tack in his speech, mixing attacks on Republicans with praise for working-class and middle-class Americans.

He said he'd "keep fighting, every single day, every single hour, every single minute to turn this economy around." He said interest groups he has battled "talk about me like a dog."

He also acknowledged that the past eight months of modest private-sector job growth hasn't been enough to bring down the unemployment rate. He said economic problems facing families today are "more serious than ever," and seemed to ask the audience in Milwaukee — and voters nationwide — for patience.

"Now here's the honest truth, the plain truth. There's no silver bullet, there's no quick fix to these problems," he said, adding that it will take time to "reverse the damage of a decade worth of policies" that caused the recession.

Administration officials said the transportation plan's initial $50 billion would be the beginning of a six-year program of transportation improvements, but they did not give an overall figure. The proposal has a longer-range focus than last year's economic stimulus bill, which was more targeted on immediate job creation.

The plan calls for rebuilding 150,000 miles of roads; building and maintaining 4,000 miles of rail lines and 150 miles of airport runways, and installing a new air navigation system to reduce travel times and delays.

Obama also called for a permanent funding mechanism, an infrastructure bank, to focus on paying for national and regional infrastructure projects. Officials provided few details of how the bank would work.

Obama said the proposal would be fully paid for. In an earlier briefing for reporters, administration officials said Obama would pay for the program by asking lawmakers to close tax breaks for oil and gas companies and multinational corporations.

The infrastructure spending is part of a package of economic proposals to be announced this week by Obama, who is feeling heat from fellow Democrats and a jittery public to show that he is focused on pumping life into the economic recovery and shrinking an unemployment rate long stuck near 10%.
